Disney is currently facing a lawsuit for “wrongful death” from a grieving widower, all because he signed up for a free trial of Disney+ five years ago. The company’s streaming services have a clause that requires mandatory arbitration instead of litigation. Now, corporate lawyers are arguing that this policy somehow applies to the case of a woman who tragically died at one of their resorts.

The Outrageous Argument

The lawyer representing the widower called Disney’s argument “outrageous and ridiculous.” He pointed out in court that Disney is essentially trying to prevent its 150 million Disney+ subscribers from filing wrongful death lawsuits in court, even if the case has nothing to do with Disney+.

CNN reported that the widower is seeking over $50,000 in damages from Disney, a company valued at $155 billion, for various reasons including emotional distress, loss of companionship, loss of earnings, and medical and funeral expenses. However, Disney’s response seems to be: Sorry, but you signed up to watch “The Mandalorian” five years ago, so we can’t help you. As of now, Disney has not responded to inquiries from Gizmodo.
